Regulatory Issues for ASCs Highlighted in N.J., Ga.

11/25/2008

An article in Modern Healthcare focuses on the current state of affairs for ambulatory surgery centers and regulatory issues in New Jersey and Georgia.

The story offers an update on the Codey Law in New Jersey, which prohibits physician self-referral except under certain scenarios, a sort of home-grown Stark law, and the current state of an amendment introduced in the state legislature, where a two-year moratorium on new surgery centers and a task force assigned to study the issue in depth during the timeout.

Meanwhile, in Georgia, lawmakers in April approved a bill that enshrines a rule favorable to general surgeons and makes a number of other changes as well — like in New Jersey, the solution to a narrow issue was a vehicle to address long-standing disagreements.
